Terms & Conditions – Chemscart
1. General
These Terms and Conditions govern all transactions between Chemscart (“we,” “our,” or “the Company”) and the buyer (“you” or “the Client”) for the sale and export of chemicals, dyes, pigments, and related products. By placing an order with us, you agree to abide by these terms.
2. Product Specifications
All products will be supplied as per the specifications mutually agreed upon in the proforma invoice or sales contract. It is the buyer’s responsibility to confirm product suitability for their intended use.
3. Pricing
Prices quoted are FOB, CIF, or as otherwise specified in the invoice. All prices are subject to change without prior notice unless otherwise confirmed in writing.
4. Orders & Minimum Quantity
Orders must meet the minimum quantity requirements as communicated. All orders are subject to acceptance and confirmation by Chemscart.
5. Payment Terms
A minimum advance payment (as agreed upon) is required at the time of order confirmation.
The remaining balance must be paid in full before delivery or dispatch of the goods.
Payments can be made via letter of credit (L\C), Bank transfer or any method mutually agreed upon.
Production and shipment will proceed only after receipt of the full payment.
Any delay in payments may impact dispatch timelines and future order processing.
6. Delivery & Shipment
Delivery timelines are approximate and subject to availability and shipping conditions.
Chemscart is not liable for delays caused by customs, force majeure events, or carrier-related issues.
Risk transfers to the buyer once the goods are handed over to the shipping agent, unless otherwise agreed.
7. Quality & Claims
All products are inspected prior to dispatch. In case of any quality issues, written claims must be made within 7 days of receipt.
No claim will be entertained once the goods are used, mixed, or processed.
8. Documentation
We will provide all standard export documentation, including Invoice, Packing List, Certificate of Origin, MSDS (Material Safety Data Sheet), and Bill of Lading unless specified otherwise.
9. Compliance
The buyer is responsible for ensuring that the imported goods comply with the local laws, customs regulations, and import requirements of their country.
10. Confidentiality
Any information shared between Chemscart and the Client, including pricing and formulation details, must remain confidential unless agreed otherwise in writing.
11. Jurisdiction
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of India. All disputes shall be subject to the jurisdiction of the courts in Surat City, India
